EasyGearNG — Terms of Use

1. Agreement to these Terms

These Terms & Conditions (“Terms”) govern your use of EasyGearNG’s website, mobile apps, and related services (collectively, the “Service”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. (Marketplace pattern adapted from common ecommerce platforms.)

2. Who we are / Contact

EasyGearNG (“EasyGear”, “we”, “us”, “our”) is an online marketplace for sports gear and apparel.

3. Scope & relationship

• EasyGear operates a marketplace connecting buyers and sellers. We facilitate listing, payment processing and delivery but individual sellers are responsible for their product descriptions and fulfilment unless otherwise stated. This marketplace model follows industry practice.
• Where we act only as an intermediary, the contract for sale is between the buyer and the seller; EasyGear is not the seller unless we expressly state otherwise.

4. Eligibility & Account registration

• You must be at least 16 years old to register and transact. Minors may use the Service under parental supervision only. (Typical marketplace requirement.)
• You agree to provide accurate, current and complete information when creating an account, and to keep it updated. You are responsible for safeguarding your credentials and for all activity on your account.

5. Orders, Pricing & Availability

• All prices on the Site are quoted in Naira (NGN) unless otherwise stated. Prices displayed include any taxes where indicated, but you are responsible for any local taxes or duties that may apply.
• We strive to keep product availability and pricing accurate but errors or delays may occur. If an item is out of stock after your order, we will notify you and offer alternatives or a refund. (Common e-commerce clause.)

6. Payment processing & accepted methods

• We accept payments through integrated payment providers (e.g., Paystack). By submitting payment you authorize the use of these payment processors; their separate terms and fees may apply. Paystack/third-party terms limit their liability for disputes and refunds.
• We do NOT store full card numbers on our servers. Tokenization and secure payment processing are used where applicable.
• You are responsible for any payment verification and for providing accurate billing information.

7. Delivery, title & risk

• Delivery terms (timing, carrier, shipping charges) are set per listing or at checkout. Title and risk in the goods pass to you in line with the chosen delivery/incoterms set out at checkout.
• If a delivery fails due to incorrect address or refusal, additional delivery charges may apply.

8. Returns, Refunds & Cancellations

• Returns and cancellations policy may vary by seller and product category. Always check the product listing for the seller’s returns policy. Where we operate as seller, our returns policy will be shown on the product page.
• For faulty or misdescribed goods, you may have rights under Nigerian consumer protection rules; contact us at hello@easygear.ng and we will help resolve the matter. (See FCCPC guidance for clear disclosures.)

9. Seller obligations (for marketplace sellers)

Sellers must: provide accurate product information, deliver on time, comply with applicable laws, and not misuse buyer data. Sellers are solely responsible for product quality, safety and any claims relating to their products. EasyGear may suspend or remove sellers who breach these Terms. (Pattern from Jumia/Konga marketplace rules.)

10. User content, reviews & moderation

• You may post reviews, ratings, questions and other content. By posting you grant EasyGear a worldwide, non-exclusive, royalty-free license to use, display and adapt that content.
• We may remove content that violates these Terms or our policies.

11. Intellectual property

All site content, logos, graphics and software are owned or licensed by EasyGear. You may not copy, republish, distribute or create derivative works without our written permission.

12. Prohibited activities

You agree not to: impersonate others, post illegal content, attempt fraud, scrape or mine data from the site, or interfere with the site’s operation. Violations may result in account suspension or legal action.

13. Privacy & data protection

Our Privacy Policy and Cookie Policy explain how we collect and use personal data. We process personal data in accordance with the Nigeria Data Protection Act, 2023 (NDPA). By using the Service you consent to such processing as described in those policies.

14. Disclaimers & Limitation of liability

• The Service is provided “as is” and to the extent permitted by law we disclaim all warranties (express or implied).
• To the maximum extent allowed by Nigerian law, EasyGear’s liability for any loss is limited to the amount you paid to us for the relevant transaction. We are not liable for indirect, consequential or special damages. (This follows common marketplace terms and Paystack/processor disclaimers.)

15. Indemnity

You agree to indemnify and hold EasyGear and its affiliates harmless from any claims, losses or expenses arising from your misuse of the Service, breach of these Terms, or violation of applicable laws.

16. Suspension & Termination

We may suspend or terminate your account for breaches of these Terms, at our discretion. Termination does not affect accrued rights or obligations.

17. Notices & communications

We may communicate with you by email, in-app notification, SMS or phone. Notices to EasyGear should be sent to: hello@easygear.ng. For legal notices send to: [Insert legal address here].

18. Governing law & dispute resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes should first be escalated to EasyGear at hello@easygear.ng. If unresolved, disputes may be referred to the Nigeria courts or alternative dispute resolution as agreed. (Standard clause mirrored from Nigerian marketplaces.)

19. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified on the Site or by email. Your continued use after changes constitutes acceptance.

20. Third-party links & services

The Site may link to third-party services (payment providers, carriers). We are not responsible for their policies or performance. Use of third-party services is subject to their own terms.

21. Severability & waiver

If any provision is found unenforceable, the remainder remains in force. Failure to enforce any right does not constitute a waiver.
